Respondents Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus forbearing the respondents from destroying the canal which is one and only water source of the Thottian Tank in the petitioner village for the purpose of laying the road.

ORDER

(Order of the Court was made by R.SUDHAKAR,J.) The prayer in the writ petition is to forbear the respondents from destroying the canal which is one and the only water source of the Thottian Tank in the petitioner village for the purpose of laying road.

proposed construction of road is in Survey Nos.289/9, 289/10, 290/3A1, 290/3A2, 290/3A3, 290/3B, 291/3A, 291/3B and the road will be adjacent to the tank and the same will definitely benefit the general public.

3.Recording the said statement made in the counter affidavit, the writ petition is closed. No costs. Consequently, M.P(MD)No.1 of 2011 is also closed.
