Prayer in Rev.Aplc(MD) Sr.No.93431 of 2025: Petition filed under Order XLVII Rule (1) and (2) and Section 114 of C.P.C to review the judgment and decree dated 27.01.2025 passed by this Court in CMA(MD) No.779 of 2023 and to deduct Rs.4,27,500/- from out of the enhanced compensation amount of Rs.68,19,671/- and further to modify the interest payable for the award amount only from the date of filing claim petition till date of payment instead of interest payable from the date of accident to till date of payment.

ORDER

(Order of the Court was made by the Hon'ble P. VELMURUGAN J.) This petition has been filed to condone the delay of 245 days in filing the Review Petition against the Decree and Judgment dated 27.01.2025 passed in CMA(MD) No.779/2023 on the file of this Court.

2.It is seen that the judgment was passed on 27.01.2025 and the same was uploaded on 18.03.2025 but the copy application was filed only on 19.08.2025 and thereafter they have filed the review application only on 29.10.2025. From the above sequence of consequences, this Court finds no bonafide reason to condone the delay. It is well settled that the delay in taking decision by the administrative officials of the appellant is not a ground to condone the delay.

3. Further the reasons stated in the petition is also not satisfactory, in view of the same, the petition stands dismissed and the review application in Sr.No.93431 of 2025 stands rejected at the SR stage itself.
