Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the Respondent No.1 to 2 give for permission conducting Mandala Poojas at Arulmigu Kombu Madasamy Temple, situated at Pettai, Tirunelveli City, which are scheduled to be held on 05.11.2025 to 25.11.2025 (21 Days) based on the Petitioner's representations dated 28.10.2025.

Heard both sides.

2. The petitioner seeks permission to conduct mandala poojai at the petition mentioned temple from 05.11.2025 to 25.11.2025. 2/4

3. This is strongly contested by the private respondents. Admittedly, the petitioner has not been recognized as trustee. He is also not the poojari of the temple. In these circumstances, it is only the trustee who is in charge of the temple, can take a decision. It is submitted that one Thiagarajan had already filed O.A before the Joint Commissioner, HR & CE Department, Palayamkottai, Tirunelveli, seeking trial of the administration. The second respondent is directed to dispose of OA within six months. The petitioner can also be examined as witness in the said OA. Independently, the petitioner is also given permission to file O.A under Section 63(e) of the HR & CE Act for establishing any of his rights such as performing pooja. If any such OA is filed, it shall be numbered immediately and it will be disposed of within six months after putting all the interested persons on notice. The writ petition is disposed of accordingly. No costs.
