Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondent nos. 1 and 2 herein to conduct survey and demarcate four boundaries in respect of the property comprised in Sur. No. 97/3B situated at Kalkathankottai Revenue Village, Ilayangudi Taluk, Sivagangai District with the aid of the respondent no.3 and consequently, direct the respondent nos. 1 and 2 to issue survey report within a stipulated time period in accordance with law on the basis of the application dated 29.07.2025.

By relying on patta No.375 in the name of Bose Devar in respect of land in survey No.97/3B, after submitting an online application on 29.07.2025, the petitioner seeks the conduct of a survey.
2. Learned counsel for the petitioner submits, on instructions, that there is no rival title claim.
3. Learned Additional Government Pleader accepts notice for respondents 1 and 2 and learned Government Advocate (Crl.Side) accepts notice for the third respondent. Learned Additional Government Pleader submits that action would be initiated within three (3) months.
4. Apart from the patta in the name of his father, the petitioner has 2/4
submitted the Death Certificate and Legal Heirship Certificate of his father. The Legal Heirship Certificate discloses the names of the petitioner, his mother and his sister. Therefore, it is necessary to issue notice to the petitioner's mother and sister before action is initiated on the request for survey. In addition, it is necessary to issue notice to owners of relevant adjacent lands and consider objections, if any, from them.
5. Subject to the above observations, this Writ Petition is disposed of by directing the first and second respondents to initiate action on the petitioner's request for a survey after issuing notice to the persons mentioned in the previous paragraph and considering objections, if any, from them.
