PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the 2nd respondent in his proceedings in Na.Ka. No.295/A1/2024 dated 26.06.2025 and quash the same as illegal and consequently direct the 2nd respondent to transfer the name of the educational agency and approve the secretary and extend the approval for Seva Primary School and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

O R D E R

The District Educational Officer (Private Schools), Madurai District, is suo motu impleaded as fourth respondent.

2. The present Writ Petition has been filed seeking to quash the order passed by the second respondent herein wherein the petitioner school has been directed to shift all the students to a nearby school. 2/6

3. A perusal of the affidavit and the counter affidavit reveals that the recognition of this school has not been extended after 31.05.2001. As a consequence, Educational Agency and the School Committee have not been approved by the concerned Authority. In such view of the matter, the Authorities have passed the present impugned order directing the school management to shift the students to a nearby school.

4. The learned Additional Government Pleader for the official respondents submits that since the recognition has not been extended after May 2001, the students cannot be permitted to undergo their education in the petitioner's school. Hence, prayed for dismissal of this Writ Petition.

5. The learned counsel appearing for the petitioner submits that they will approach the authorities with an appropriate application seeking extension of recognition and after obtaining recognition, they will seek approval of Educational Agency and School Committee, accordingly.

6. Considering the fact that the students are in the middle of the academic year, the Authorities shall not disturb the students upto 30.04.2026. 3/6

The petitioner school is directed to approach the Authorities and obtain recognition of the school before the said date. In case the recognition is not granted on or before 30.04.2026, the petitioner school shall not admit any student from the academic year 2026-27. Depending upon the recognition to be passed by the concerned authorities, the school may approach the respondents seeking approval of Educational Agency and School Committee.
