PRAYER :-This petition is filed under Section 528 of BNSS,2023, to direct Respondents No.1 and 2 to provide adequate police protection to the petitioner against respondent Nos.3 and 4 based on the representation dated 23.10.2025.

ORDER

This Criminal Original Petition is filed seeking a direction to the respondents 1 and 2 to provide police protection as against the respondents 3 and 4 based on the petitioner's representation dated 23.10.2025.

2. The learned counsel for the petitioner would submit that there are several litigations pending between the petitioner and the third respondent; and that the third respondent had illegally entered into the petitioner's property and caused damage to the same. 2/5

3. The learned counsel for the third respondent, however, would submit that the property belongs to the third respondent and he is in possession of the same and the Police cannot interfere into such dispute.

4. Admittedly, there are several litigations pending between the parties. One of the property disputes between the parties culminated vide common judgment dated 02.09.2025 by the learned Principal Sub Judge, Palani, in O.S.Nos.358 of 2018 and 545 of 2016.

5. Hence the police shall not interfere in any civil dispute between the petitioner and the third respondent. However, if any cognizable offence is made out on the complaint of the petitioner, it is open to the respondents 1 and 2 to take suitable action in accordance with law.

6. With the above liberty, this Criminal Original Petition is disposed of.
