Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the second to fourth respondents to conduct the survey in the petitioner son's property in vide Survey No.220/2B to the extent of 6 cent at Kallanai Village, Vadipatti Taluk, Madurai District, on the basis of the petitioner's representation dated on 19.09.2025.

O R D E R

This petition is presented by the duly constituted agent of Gowthaman and Gowsheekan, who are the sons of the agent. By relying on a sale deed dated 07.11.2024 (Doc.No.4523 of 2024) and patta No. 4873, the petitioner had applied for a survey of 2.42 ares or 6 cents in survey No.220/2B. This Writ Petition relates thereto.

2. Learned Additional Government Pleader accepts notice for respondents 1 to 4. He submits that the notice would be issued to owners of relevant adjacent lands and to the fifth respondent before taking a 2/5

decision.

3. The petitioner has placed on record both title and revenue records relating to the property. On perusal of the sale deed, it appears that the fifth respondent is the petitioner's vendor. The patta in favour of the fifth respondent is also on record and the patta reveals that the survey No.220/2 before subdivision was for an extent of 1 hectare and 92.50 ares. This appears to have been subdivided subsequently and the petitioner's request for a survey is restricted to subdivided survey No. 220/2B of an extent of 2.42 ares.

4. Learned counsel for the petitioner has confirmed that there is no rival title claim.

5. In view of the submission of the learned counsel for the petitioner, it is unnecessary to issue notice to the fifth respondent in this Writ Petition. Instead, this Writ Petition is disposed of by directing the second to fourth respondents to initiate action on the petitioner's request for a survey after issuing notice to the fifth respondent and the owners of 3/5

relevant adjacent lands. Objections, if any, from the said persons shall be taken into consideration. The entire process will be concluded within three (3) months from the date of receipt of a copy of this order. No costs. W.M.P.(MD) No.26221 of 2025 is allowed.
