Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, to direct the 1st respondent to revise petitioner's scale of pay w.e.f. 01.09.2019 based on the new wage settlement dated 24.08.2022 (14th wages settlement) made u/s. 12(3) of the I.D.Act and consequently to pay the petitioner difference/arrears of wages for the period from 01.09.2019 to 31.05.2022 and also the difference in petitioner's terminal benefits namely Gratuity, Encashment of Leave, after revising the same based on such re-fixed scale of pay payable to the petitioner on the month of the petitioner's retirement, together with 18% interest per annum within a time frame as may be fixed by this Court.

ORDER

The petitioner, a retired driver of the Transport Corporation, has filed this writ petition seeking a direction to the first respondent to revise his scale of pay, as per the settlement arrived under Section 12(3) of the Industrial Disputes Act, dated 24.08.2022 and to settle the difference/arrears of wages.

2. The respondents have taken notice through their respective counsel in this writ petition. The second respondent has filed a counter affidavit admitting that there is a difference of pay, which is due to the petitioner, to be paid by the Management.

3. The learned counsel have also sought eight weeks' time to settle the diffierence of pay, as per the settlement arrived under Section 12(3) of the Industrial Disputes Act.

4. In view of the same, this writ petition is disposed of with a direction to the respondents to settle the difference of pay, as per the settlement arrived under Section 12(3) of the Industrial Disputes Act, to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
