ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 75(1)(i), 75(1)(ii), and 351(2) of BNS, 2023, in Crime No.39 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner is the father of the defacto complainant and she born through the 2nd wife of the petitioner and the petitioner sexually harassed the defacto complainant and also threatened her. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offences as alleged by the prosecution, and he has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks bail for the petitioner.

4. The learned Additional Public Prosecutor submitted that the 2/4

investigation is going on and he produced the 164 statement of the victim girl. However, he opposed for grant of bail to the petitioner.

5. Perusal of 164 statement reveals that the defacto complainant is the daughter born through the 2nd wife of the petitioner and inspite of being the father, the petitioner has harassed the victim sexually and she has narrated the trauma she has undergone. Therefore after reading the same, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 04.11.2025 PJL To 1.The Inspector of Police, All Women Police Station, Dindigul, Dindigul District.
