Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to provide new electricity service connection based on the petitioner's application dated 16.09.2025 to the petitioner's house situated at Door No. 45 in T.S.No.8644, in Alavayal, Pudukkottai Town and Taluk, Pudukkottai District.

ORDER
This writ petition has been filed seeking Mandamus to the respondents to provide new electricity service connection to the petitioner's house situated at Door No.45 in T.S.No.8644, in Alavayal, Pudukkottai Town and Taluk, Pudukkottai District, based on her application dated 16.09.2025.

Heard the arguments of the learned counsel appearing for the petitioner and Mr.S.Deenadhayalan, learned Standing Counsel, appearing on behalf of the respondents 1 and 2, Mr.P.Subba Raj, learned Special Government Pleader, appearing for the third respondent and Mr.G.Mathavan, learned Counsel, appearing for the fourth respondent. 2/6
3. The petitioner's contention is that she is residing at Door No.45, which is situated in T.S.No.8644, Alavayal, Pudukkottai Town and Taluk, Pudukkottai District. Whereas, the Executive Officer, who is the fourth respondent herein, has filed a counter affidavit contending that the writ petitioner has encroached in T.S.No.8645/34 to an extent of 3538 sq.ft., the four boundaries of her house are as follows:- Eastern side Ravi house, Northern side Dhanalakshmi side, West and South side Salai.
and that she is not residing in T.S.No.8644, but has claimed the connection to the house, which is situated in another survey number, namely, T.S.No. 8645/34 by misusing the tax receipt, which has been issued in respect of T.S.No.8644.
4.In view of the above, since there is a dispute regarding the identity of the property, particularly, the survey number in which the property in question is situated, the Tahsildar, Pudukkottai, on the request of the second respondent, shall inspect the property in question, identify the survey number in which the petitioner, Amma Kannu's property is situated and upon receiving the report from the Tahsildar, further proceedings will be taken by the second respondent. In the event the survey reveals that the house is not situated in T.S.No.8644, connection shall not be effected in favour of the petitioner, otherwise electricity connection shall be given 3/6
subject to the petitioner furnishing undertaking affidavit stating that as and when the proceedings initiated against her are ultimately decided adversely, the electricity service connection can be discontinued forthwith.
