O R D E R

This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the first and second respondents to take necessary action to effect mutation in the revenue records in respect of the property in Survey No.34/1G, Ramambal Village, Madukkur, Pattukottai Taluk, Thanjavur District and to issue patta to the petitioner for an extent of 11 cents instead of 9 cents.

2. The grievance of the petitioner is that she is the absolute owner of the subject property measuring an extent of 11 cents. However, the patta stands in her name only for an extent of 9 cents. From the year 1986, she has been attempting to effect mutation in the revenue records. However, no mutation has been effected. In the meantime, the property was subdivided and Survey No.34/1G was allotted to the petitioner, but no separate patta has been issued. Taking advantage of the discrepancy in the revenue records, the third respondent, who is the adjacent landowner, Page No. 2 of 5

encroached upon the property and approached the second respondent for removal of the encroachment. However, without considering the petitioner's case, the second respondent passed an order dated 15.07.2025 for removal of the encroachment. The petitioner thereafter submitted a representation dated 26.07.2025 to the first and second respondents; however, no action has been taken. Therefore, the petitioner has been constrained to file the present Writ Petition.

3. The learned Special Government Pleader appearing for the first and second respondents, on instructions, would submit that the petitioner's representation dated 26.07.2025 would be considered and appropriate orders would be passed by the second respondent within a period of twelve weeks.

4. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 26.07.2025 and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting enquiry. It is Page No. 3 of 5

needless to state that before passing any order, the petitioner, the third respondent and any other parties who may be affected by such decision shall be heard. There shall be no order as to costs.
