O R D E R
An order dated 13.02.2025 of the Tahsildar is impugned in this Writ Petition primarily on the ground that the release deed dated 17.07.1971 was not duly considered.

Learned counsel for the petitioner invited my attention to the deed and pointed out that one Namachivayam had released his rights to the properties described in the schedule to such release deed in favour of Vinayaga Sundaram in exchange for monetary consideration. Because the said document was not duly considered, he submits that the impugned order is liable to be set aside.
3. Learned Special Government Pleader accepts notice for all the respondents. By referring to the impugned order, he points out that the details of Natham Survey No.189 are not contained in the release deed 2/5
handed over by the petitioner to the Tahsildar and that only pages 1, 2, 3, 4, 5 and 7 of the said document had been provided. He also points out that Natham Survey No.1847/12 was subdivided into 1847/12A and 1847/12B and that patta No.1102 was issued to Namasivayam in respect of survey No.1847/12B. Similarly, he submits that patta No.1218 was issued in favour of Dandapani, Kalyanasundaram and Godhandapani in respect of survey No.1847/12A. In these circumstances, he submits that no interference is required.

The order impugned herein has been issued after providing a reasonable opportunity to the petitioner and after taking into consideration all material documents, including the release deed bearing Doc.No.1977 of 1971. The Tamil Nadu Patta Passbook Act, 1983, provides for an appeal before the Revenue Divisional Officer. In view thereof, in the facts and circumstances discussed above, I am not inclined to exercise discretionary jurisdiction.
5. Therefore, this Writ Petition is disposed of by leaving it open to the petitioner to file an appeal before the Revenue Divisional Officer. If 3/5
such appeal is presented within thirty (30) days from the date of receipt of a copy of this order, the Revenue Divisional Officer is directed to receive and dispose of the same on merits within three (3) months from the date of receipt thereof, after providing a reasonable opportunity to all parties concerned and without going into the question of limitation.
