and to the directed 3rd respondent not to register the document filed by the 4 to 6 respondents in Survey No.292/21, measuring about 0.08.49, cents 21 in connection with suit No O.S.No.202 of 2025 on the file of the Sub Court, Manamadurai.

ORDER

Heard the learned counsel for the writ petitioner and the learned Government Advocate for the respondents 1 to 3. Issuance of notice to the respondents 4 to 6 is dispensed with.

2.The petitioner states that the private respondents are utter strangers to the petition mentioned property and that they should not be allowed to deal with the same. The petitioner called upon the registering authority not to register any document that may be received from the private respondents. The registering authority called upon the petitioner to go before the jurisdictional Civil Court and obtain an injunction order. The registering authority made it clear that any restraint order received 2/6

from the jurisdictional Court will be honoured. Challenging the said stand of the registering authority, this writ petition has been filed. 3.The registering authority had rightly called upon the petitioner to move the jurisdictional Civil Court. If the petitioner's complaint is to be accepted, then the registering authority will have to undertake title investigation. The Hono'ble Supreme Court in a recent decision reported in 2025 INSC 462 (K.Gopi Vs. The Sub Registrar and Others) had observed that it is not job of the registering authority to investigate the title of the executant of the document.

4.In this view of the matter, granting liberty to the writ petitioner to go before the jurisdictional Civil Court, this writ petition is disposed of. No costs.
