PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus thereby direct the respondents to rectify the mistake in measurement 1.5 cent lesser than what the petitioner is entitled to in S.No.15/2B2-1.5 cent of Subramaniyapuram Village, Sivagiri Taluk and Tenkasi District and issue patta for the correct extent within a reasonable time to be granted by this court.

ORDER

By relying on sale deed dated 06.05.2010 in favour of the petitioner and by tracing title from one Balagurusamy, who had purchased the land in S.No. 15/2B2 on 13.06.1983, the petitioner had submitted a representation for rectification of the error in the revenue records. This writ petition relates thereto.

Learned counsel for the petitioner submits that all the above mentioned sale deeds indicate the extent of the property as 4 cents, whereas the revenue records erroneously mention the extent as 1 are, which is roughly equivalent to 2.47 cents. Therefore, he submits that the petitioner is entitled to rectification.

3. Learned Additional Government Pleader accepts notice for all the respondents. He submits that the matter is pending consideration by the Revenue Divisional Officer and that an order would be issued on merits within three months.

Accordingly, without expressing any opinion on the merits, this writ petition is disposed of by directing the 3rd respondent to consider the petitioner's request for rectification of revenue records and to pass a speaking order within three months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner.
