ORDER

The petitioner has filed the present Writ Petition praying to direct the the respondents to absorb the petitioner in to the Board service and appoint him as Mazdoor/Temporary Casual Labour as per the petitioner eligibility within the period stipulated by this Hon'ble Court. 2.The respondents have filed the counter affidavit stating that the petitioner has filed a petition before the Assistant Commissioner of Labour (Authority under conferment of Permanent Status) Act 1981. According to the respondent, the said petition is still pending.

3. Heard Mr.A.Haja Mohideen, learned counsel appearing for the petitioner and Mr.C.Selvaraj, learned counsel appearing for the respondent.

4. In view of the pendency of the application before the Assistant Commissioner of Labour, this petition is not maintainable. Hence, the writ petition is dismissed. It is open to the petitioner to take further proceedings depending upon the order passed by the Assistant Commissioner of Labour. No costs.
