Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to conduct the survey in Survey No.710/4 with an extent of 12 1/2 cents situated at Ward No.8, Sambavarvadakarai Village, Kadayanallur Taluk, Tenkasi District based on the petitioner's representation dated 28.08.2025 as well as to direct the third respondent to give adequate police protection during survey conducting by the second respondent within a stipulated time fixed by this Court. 1/5

O R D E R

By relying on a sale deed dated 25.03.1997 in favour of the petitioner's husband, a sale deed dated 01.03.2021 in favour of the petitioner's daughter and the death certificate and legal heirship certificate relating to the petitioner's husband, the petitioner had applied for a survey of the property in survey No.710/4.

2. Learned counsel for the petitioner submits that the petitioner's husband had purchased 5 cents of land and that the petitioner's daughter had purchased the remaining 7 1⁄2 cents. She further submits that a survey is necessary so as to demarcate the boundaries.

3. Learned Special Government Pleader accepts notice for respondents 1 and 2 and learned Government Advocate (Crl.Side) 2/5

accepts notice for third respondent. Learned Special Government Pleader submits that an inquiry would be conducted in relation to the petitioner's request and that notice would be issued to the petitioner, the fourth respondent and the joint pattadars under patta No.3496 and owners of relevant adjacent lands.

4. In view of the above submissions, it is unnecessary to issue notice to the fourth respondent in this Writ Petition. Instead, this Writ Petition is disposed of by directing the first respondent to conduct an inquiry in relation to the petitioner's request for a survey after issuing notice to the pattadars under patta No.3496, all the legal heirs of the late Muppulimaadan and to the owners of relevant adjacent lands. The objections of such persons, if any, shall be taken into account before a decision is taken. A speaking order shall be issued within three (3) months from the date of receipt of a copy of this order. No costs. NCS : Yes/No 06.11.2025 Index : Yes / No Internet : Yes / No apd 3/5
