Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus, directing the respondents to release the payment of Rs.28,295/- withheld by the respondents towards alleged loss to the Corporation and also the interest on the delayed payment of disbursement of terminal benefits as claimed by the petitioner in his representation dated 18.01.2011.

ORDER

The grievances of the writ petitioner is that the terminal and retirement benefits was settled in favour of the writ petitioner withholding the amount of Rs.28,295/- towards the alleged loss occurred to the Corporation. However, the writ petitioner is unable to know the reason for such withholding of a portion of the terminal benefits. In this regard, he submitted representation to the respondents on 09.02.2011 and the same is yet to be considered by the respondents.

respondent is directed to consider the representation submitted by the writ petitioner on 09.02.2011 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to submit a copy of the representation and the documents, if any, along with a copy of the orders passed in this writ petition.

3.Accordingly, the writ petition stands disposed of. However, there shall be no orders as to costs. Consequently, MP(MD)No.1 of 2011 is closed.
