PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS directing the respondents to inspect and conduct a resurvey in respect of the petitioner lands comprised in Survey Nos. 263/4A, 265/2B and 266/1(now subdivided as 266/1A), situated at Kapiliyapatti Village, Oddanchatram, Dindigul District, and consequently to rectify the erroneous sub-division and FMB entries and issue patta in his favour, in light of the proceedings dated 16.05.2025.

ORDER

According to the petitioner, the lands in S.No.266/1 were acquired for the purpose of four laning and strengthening State Highway-37. However, it is stated that the roads were laid in a different location, which does not correspond to the lands acquired under the original acquisition proceedings. After submitting multiple representations to conduct a resurvey, rectify the wrong subdivisions and correct the FMB entries as per site conditions, the petitioner has filed the present writ petition.

2. Learned Special Government Pleader accepts notice for all the respondents. On the basis of written instructions, he submits that the survey would be undertaken within two months from the date of receipt of a copy of this order.

By taking note of the submissions of learned Special Government Pleader, this writ petition is disposed of by directing the second respondent to carry out a survey of lands in subdivided S.No.266/1A within two months from the date of receipt of a copy of this order and to consider and dispose of the petitioner's request for rectification of the subdivision and FMB entries on merits based on the outcome of the survey. The entire process shall be concluded within four months from the date of receipt of a copy of this order. No costs.
