The petitioner asserts that he was the owner of the land in survey No.267/1, which was later subdivided as survey No.267/1B and thereafter, as survey Nos.267/1B1 and 267/1B2. As regards the land survey No.267/1B2, he states that 695 sq.m. were acquired from the petitioner and compensation of ?5,60,311/- was paid in respect thereof. On the ground that the actual extent earlier owned and occupied by the petitioner was greater than 695 sq.m., the petitioner had made a representation to either return the excess extent or pay compensation in respect thereof.
2. Learned Additional Government Pleader accepts notice for all the respondents. He submits that the survey would be conducted within 2/4
two (2) months and further action would be taken if it is found that the land acquired from the petitioner exceeds 695 sq.m.
3. By taking note of the above submissions, this Writ Petition is disposed of by directing the respondents 2 to 4 to carry on a survey within two (2) months and thereafter, take necessary action to either return the lands in excess of 695 sq.m. or to take steps to fix and pay compensation in respect thereof. No costs.
