ORDER : The Court made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 329(4), 296(b), 131, 324(4), 49, and 351(2) of BNS, 2023 in Crime No.591 of 2025 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the petitioner and other accused persons trespassed into the house of the defacto complainant and assaulted him, damaged the household articles and taken 3 sovereign of gold chain and also abused him using filthy language and also threatened him with dire consequences. Hence, the complaint.

The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offences as alleged by the prosecution, and he has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that the petitioner has no previous cases. The specific overtact against the petitioner is that he instigated the other accused to commit the crime and monitoring the occurrence through mobile phone. However, he opposed for grant of anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and also the fact that though the petitioner is having no previous cases, the specific overtact against the petitioner is that he instigated the other accused persons to commit the crime and he was monitoring the occurrence through his mobile phone, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
