The above miscellaneous petition is filed to condone the delay of 53 days in filing the criminal appeal as against the order dated 25.02.2025 passed in Crl.MP.No.1150/2024 in Spl.SC.No.

43/2020 on the file of the learned Special Court for Trial of Cases under SC/ST [POA] Act, Theni.

2.Heard the learned counsel for the petitioner and the learned Government Advocate [Crl.Side] appearing for the 1st respondent.

3.Mr.M.Gandhi Rajan, learned counsel undertakes to file Vakalat for the 2nd respondent/defacto complainant and he has no objection in the petition being allowed and the delay being condoned.

4.Being satisfied with the reasons stated in the affidavit filed in support of the petition and recording the no objection expressed by the learned counsel for the 2nd respondent, this Court is inclined to condone the delay.

5.Accordingly, the petition is ordered and the delay of 53 days in filing the criminal appeal is condoned.

6.The Registry is directed to number the criminal appeal, if the papers are otherwise in order and list the same for admission.
