BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED :06.11.2025

CORAM:

THE HONOURABLE MR JUSTICE SENTHILKUMAR RAMAMOORTHY and W.M.P.(MD) No.24646 of 2025 M.Kumar ... Petitioner Vs

1. The District Collector, Kanyakumari District.

2. The Sub-Collector, Padhmanabapuram, Takkalai (Po) - 629 175, Kanyakumari District.

3. The Tahsildhar, Takkalai and Post, Kanyakumari District - 629 175.

... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the third respondent dated 18.08.2025 in Se.Mu.No.Aa3/3129/2024 and quash the same and consequently, direct the third respondent to issue Patta in respect of the land in Survey No.474/1 situated at Villukuri Village, Kalkulam Taluk, Kanyakumari District to the Petitioner. 1/5

For Petitioner : Mr. S.Ramasamy For Respondents : Mr.P.Thambidurai Government Advocate

O R D E R

The petitioner assails an order dated 18.08.2025 rejecting the petitioner's request for grant of patta in respect of the land in survey No. 474/1, Villukuri Village.

2. Learned counsel for the petitioner submits that the petitioner has been running a shop selling tender coconut at the location for more than eight years. He relies upon the certificate issued in this connection by the Village Administrative Officer. He also states that it is incorrect that the petitioner owns another property at survey No.630/17.

3. Learned Government Advocate accepts notice for all the respondents. He submits that the relevant site is located on the boundary of the National Highway from Nagercoil to Trivandrum. Therefore, he submits that such land would be required for road widening purposes. He also states that the petitioner is wealthy and owns a property purchased 2/5

for a considerable sum.

4. On perusal of the impugned order, it is seen that the Tahsildar took into account the fact that the land is classified in the 'A' Register as 'Oor Natham'. The Tahsildar has also referred to the fact that the petitioner owns a property bearing door No.2/212B in survey No.630/40 ad measuring 1.20 ares purchased by the petitioner for a sum of about ? 11,00,000/-. It is also stated that the petitioner has built a house and has been residing there for about 15 years. The order also records that the value of the land occupied by the petitioner is about ?10,00,000/-. It is recorded further that since the land abuts the National Highway, it would be required for expansion thereof. I find that cogent reasons have been set out for rejecting the petitioner's request. Therefore, I see no reason to interfere in exercise of discretionary jurisdiction. For these reasons, this Writ Petition is dismissed without any order as to costs. Consequently, connected miscellaneous petition is closed.
