dated 17/03/2025.

O R D E R

The petitioner challenges an order dated 12.07.2025 rejecting the request for issuance of patta in respect of resurvey No.26/2B1A part. The principal ground on which the order is challenged is that the order is unreasoned.

2. Learned Special Government Pleader accepts notice for respondents 1 and 2. He submits that the matter may be remanded for reconsideration.

3. On perusal of the impugned order, the reason for rejection is recorded as the alphabet 'S'. Undoubtedly, the order is completely unreasoned and unsustainable. Although a private respondent has been arrayed, such respondent is the petitioner's vendor, as evidenced by the 2/4

sale deed dated 17.03.2023. Therefore, it is not necessary to issue notice to the third respondent before disposing after the petition.

4. For reasons aforesaid, this Writ Petition is allowed by setting aside the impugned order dated 12.07.2025 and remanding the matter to the Tahsildar for reconsideration. After providing a reasonable opportunity to the petitioner and any other persons concerned, a speaking order shall be issued within three (3) months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
