ORDER
(Order of the Court was made by DR.ANITA SUMANTH, J.) The prayer of the petitioner is for a mandamus directing the respondents not to locate TASMAC shop within the jurisdiction of Karaiyur Village, Ponnamaravathi Taluk, Pudukkottai District. 2.The petitioner claims to have made objections to the present proposal to open a TASMAC shop in the aforesaid location. 3.On 07.11.2025, we had recorded the statements of the respondents to the effect that no license has been issued as on date for 2/6
opening a shop in the aforesaid location. This position continues as on date and hence, it would suffice for us to direct the respondents to ensure that the objections of the petitioner as well as any other persons, who object to the opening of the shop on both Rules touching upon proximity as well as distance and other stipulations under Tamil Nadu Liquor Retail Vending (in Shops and Bars) Rules, 2003 be properly considered. After hearing the objectors, a speaking order shall be passed. 4.The learned counsel for the petitioner states that the villagers had unanimously passed a resolution not to permit opening of a TASMAC shop. If this is the Will of the people, then the same may be put forth to the authorities for their due consideration. 5.With this and as the purpose of the mandamus has been achieved, this writ petition is disposed. No costs. Consequently, connected miscellaneous petition is closed.
