Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to revise the petitioner's pension by treating the petitioner as Typist Selection Grade with effect from 01.10.1978 and as Typist Special Grade with effect from 01.10.1988 and as Typist Grade I with effect from 01.10.1996 pay the arrears of pension payable to the petitioner along with interest and also pay the interest on Rs.51,057/- for the period from 30.11.2011 to the date of payment namely 09.12.2011. ORDER

The grievance of the writ petitioner is that the revised pension as applicable as per the Government Order has not been

paid and therefore, the petitioner is constrained to move the present writ petition.

2.The writ petitioner was employed as Typist and retired from service. However, the pay as admissible in accordance with the Government Order and Pay Rules has not been settled in favour of the writ petitioner. In spite of several proposals, the pay as applicable has not been fixed. The writ petitioner in this regard, submitted a representations to the respondents on 01.09.2013 and 04.09.2013. The same is yet to be considered. 3.Thus, without going into merits of the matter, the fourth respondent is directed to consider the representation submitted by the petitioner, dated 01.09.2013 and 04.09.2013 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose all the copies of the representations and the Government Orders, if any, along with the order passed in this writ petition.

4.Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs.
