PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus forbearing the respondents No.1 to 3 herein, from providing electricity connection to the respondents 4 and 5 herein in respect of the property in New Survey No.1472, to the extent of 7 acres and 78 cents situated at Pannaikadu Village, Kodaikanal Taluk.

ORDER

This writ petition has been filed by the petitioner to issue a writ of Mandamus forbearing the respondents No.1 to 3 herein, from providing electricity connection to the respondents 4 and 5 herein in respect of the property in New Survey No.1472, to the extent of 7 acres and 78 cents situated at Pannaikadu Village, Kodaikanal Taluk.

2. When the matter was taken up for hearing, the learned Counsel appearing for the respondents 1 to 3 has submitted that though an order of interim injunction was initially granted in O.S.No.115 of 2011, subsequently, the same was vacated, pursuant to which, the electricity service connection has been provided to the premises of the respondents 4 & 5 and hence, this writ petition has become infructuous, as nothing survives for further adjudication in this matter.

3. Recording the said submission, this writ petition is closed and there is no impediment for the department to proceed further in accordance with law.

No costs. Consequently, connected miscellaneous petition is closed.
