O R D E R
The appellant availed loan from the respondent. He committed default. Since the agreement between the parties contained an arbitration clause, the matter was referred to an Arbitrator. An arbitration award was also passed. Challenging the same, the appellant herein filed Ar.O.P.No.65 of 2023 before the Principal District Judge, Kanyakumari under Section 34 of the Arbitration and Conciliation Act, 1996. The learned District Judge dismissed the petition vide order dated 24.09.2025. Aggrieved by the same, this Arbitration appeal came to be filed.
2. We suggested to the learned counsel on either side to explore the possibilities of amicably resolving the matter. We are happy to record that settlement talks were conducted and the matter has been settled in full. A joint compromise memo signed by the parties as well as their respective counsel has been filed before this Court. This arbitration appeal is disposed of in terms of the joint compromise memo dated 21.01.2026.

3. We place on record that the appellant had paid a sum of Rs.22,00,000/- by way of two demand drafts directly to the respondent. The learned counsel appearing for the respondent has also handed over the original document to the learned counsel for the appellant in our presence. This arbitration appeal is disposed of accordingly.
4. Since the matter has been amicably settled out of Court, the appellant is entitled to refund of the Court fee paid before this Court as per rules. Since the matter has been settled and the respondent's claim has also been settled in full, E.P.No.16 of 2023 on the file of the Principal District Judge, Kanyakumari District stands terminated.
