ORDER

This Criminal Original Petition is filed to direct the respondent Police to provide adequate police protection to the petitioner on the basis of his representation dated 06.09.2025 and prevent the third respondent from interfering with the petitioner's possession.

2. It is the case of the petitioner that his brother had filed a suit in O.S.No.58 of 2003 for permanent injunction against the third respondent, which was dismissed; that the petitioner's brother had filed an appeal before the Sub Court in A.S.No.26 of 2009 and the same was allowed; and that inspite of the same, the third respondent is interfering with the petitioner's possession.

3. This Court is of the view that if the third respondent is disobeying any direction of the Civil Court, it is for the petitioner to seek execution of the decree in favour of his brother. The respondent Police cannot interfere in such a dispute. However, it is needless to say that the respondent Police may take appropriate action if a cognizable offence is made out. 2/4

4. With the above observations, this Criminal Original Petition is disposed of.
