ORDER

The petitioner is accused No.14 in SplSC.No.2 of 2026 on the file of the learned Chief Judicial Magistrate, Pudukottai. He has moved this petition to quash the proceedings pending against him in SplSC.No.2 of 2020.

2.The main contention of the petitioner is that though the prosecution has been laid against 14 persons, 10 of them were discharged by the trial court. However, the petitioner has failed to file a petition to discharge. The petitioner is also a similarly placed person as that of the persons, who have been discharged.

3.The learned Additional Public Prosecutor appearing for the3 respondent submits that though some of the accused were discharged, the trial is pending as against the then President, who has paid money, then Panchayat Secretary, who is responsible for making payment and then BDO/ A11.

4.The allegation as against this petitioner is that the petitioner being a Village Assistant has drawn salary in his name as if he has worked under Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGA) .

5.Considering the prima facie materials and also merely because some of the accused persons were discharged, this court is not inclined to interfere with the proceedings pending against the petitioner. Accordingly, this petition is dismissed. Since the case is of the year 2020, the trial court is directed to conclude the trial as expeditiously as possible.
