Chendur Pandian : Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of Mandamus directing the first respondent to accept the penal kist from the petitioner and to issue B Memo in respect of the land in Survey No.329, measuring about 6 acres in Palayakayal Village, Srivaikuntam Taluk, Thoothukudi District.

The petitioner submitted a representation dated 11.07.2011 to the first respondent to accept the penal kist from him in respect of the land in Survey No.329, Palayakayal Village, Srivaikuntam Taluk, Thoothukudi District. Since there was no follow up action taken by the first respondent, the petitioner has come up with this Writ Petition.

2. The first respondent is directed to consider and dispose of the representation dated 11.07.2011 on merits and as per law. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

3. However, I make it clear that I have not considered the right of the petitioner to call upon the first respondent to accept the penal kist. It is for the first respondent to decide the matter, with notice to all the interested parties. The petitioner is directed to forward a copy of the representation along with a copy of this order so as to enable the first respondent to pass appropriate orders as expeditiously as possible.

5. The Writ Petition is disposed of with the above direction. No costs.
