None appears on behalf of the petitioner.

The learned counsel for the fourth respondent, on instructions, submitted that the Tahsildar, Aruppukkottai, the second respondent herein, has already rejected the petition filed by the petitioner for surveying the land in question, by order dated 25.07.2011. The rejection was made on account of the pendency of a Civil Suit filed by the fourth respondent in O.S.No.365 of 2010, on the file of District Munsif Court, Aruppukkottai.

2. There is no dispute that the fourth respondent filed a suit in O.S.No.365 of 2010 before the District Munsif Court, Aruppukkottai against the petitioner. The suit is still pending. In view of the pendency of the suit, the Tahsildar, Aruppukkottai, rejected the petition submitted by the petitioner for surveying the land in question by order dated 25.07.2011.

3. In view of the order dated 25.07.2011, the petitioner is not entitled to a Writ of Mandamus, as prayed for in the Writ Petition. It is open to the petitioner to challenge the order, if he is so advised.

4. The Writ Petition is dismissed with the above observation. No costs.
