PRAYER :- This petition is filed under Section 528 of BNSS, 2023, to transfer the investigation in connection with petitioner complaint dated 09.10.2025 from the file of the 3rd respondent to CBCID / 4th respondent or any other independent investigation agency under the supervision of the 1st respondent and consequently take necessary action within a stipulated period as may be fixed by this Court by considering the petitioner's representation, dated 29.10.2025. ORDER

The petitioner seeks a direction to transfer the investigation in connection with petitioner's complaint, dated 09.10.2025 from the file of the 3rd respondent to CBCID / 4th respondent or any other independent investigation agency under the supervision of the 1st respondent and consequently take necessary action within a stipulated period as may be fixed by this Court by considering the petitioner's representation, dated 29.10.2025.

2. The Additional Public Prosecutor, on instructions, would submit that no FIR has been registered in respect of the petitioner's complaint and consequently, no investigation is pending. The petitioner's complaint is only at the stage of enquiry to ascertain whether any cognizable offence is made out.

3. In view of the aforesaid submission, this Court is not inclined to transfer the enquiry at this stage. However, the respondents shall complete the enquiry and communicate the result of the same to the petitioner within a period of two weeks from the date of receipt of a copy of this order.

4. With the above direction, this Criminal Original Petition is disposed of.
