Respondents Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order passed by the 2nd Respondent in his proceedings Letter No.MH.25/1404/90 dated 24.10.2013 and quash the same and consequently direct the 2nd Respondent to proceed the legal action against the 3rd Respondent who is allottee of the said house and allow the Petitioner to live with his family peacefully. ORDER

When the matter is taken up for hearing, there is no https://hcservices.ecourts.gov.in/hcservices/ representation on behalf of the petitioner. Initially, the petitioner challenged the eviction notice issued by the respondents 1 and 2.

However, according to the learned Standing Counsel for the official respondents, the petitioner has already vacated the premises in question and handed over the same to the official respondents. To sum up, he would contend that nothing survives in the present Writ Petition.
