O R D E R
(Order of the Court was made by C.V.Karthikeyan, J.) This HCP has been filed by a father complaining that his minor child, aged about 15 years, has been missing or under the custody of the second respondent/his wife.
2. It is to be noted that the petitioner had filed H.M.O.P.No. 916 of 2025 under Section 9 of the Hindu Marriage Act, 1955, on the file of the Family Court, Madurai, seeking restitution of conjugal rights. The petitioner may work out his remedy in the said HMOP and also file necessary application seeking interim visitation right.
3. We are confident that the learned Family Court Judge, Madurai would take a considered view of the entire issue and pass appropriate orders. There is no illegal confinement of the son of the petitioner herein. The third respondent is also employed as Principal in Government Arts and Science College, Melur, Madurai District and
therefore, she cannot be said to have shifted her residence. Her place of employment is permanent and the petitioner is also aware of the same.
4. Giving that particular liberty to the petitioner, the Habeas Corpus Petition is closed.
