ORDER
The present writ petition has been filed seeking to quash the order passed by the third respondent, wherein, the request of the writ petitioner for issuance of a legal heirship certificate for the death of her husband has been rejected.
2. A perusal of the impugned order reveals that the deceased, namely, Ganeshan, had two wives and that there were rival claims. On the said ground, the application for issuance of a legal heirship certificate was rejected.
3. The learned counsel appearing on either side submitted that the fifth respondent herein is the first wife of the deceased Ganeshan and after the death 2/5
of the said Ganeshan, she has got remarried to one Krishnan. Through the first marriage, the sixth respondent was born. It is also submitted by either side that the said Ganeshan got married to the writ petitioner as his second wife and through him, a son by name, Saravanan and daughter by name, Sangeetha were born. The parties have also admitted that the deceased Ganesan was survived by his mother, Rakkammal.

According to the learned counsel appearing on either side, excluding the name of Murugeshwari, they have agreed to incorporate the names of Pandimeenal, Jeya Lakshmi, Saravanan, Sangeetha and Rakkammal as the legal heirs of the deceased Ganeshan and they have also entered into an agreement on 10.10.2025.

In view of the above said facts, the order impugned in this writ petition is set aside and the matter is remanded back to the file of the third respondent and the third respondent is directed to conduct an enquiry and hear all the legal heirs and thereafter, pass appropriate orders on merits and in accordance with law. The said exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.
