ORDER

The petitioner/Sole accused, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 8(c) r/w 20(b) (ii)(C), 28 and 29 of NDPS Act, 1985 in NCB.F.No.48/1/03/2020/NCBMDU on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that on 31.12.2020 at around 11.30 hours, when the respondent police were in surveillance, they found that the accused were found to be in possession of 90.300 kgms of ganja kept in a car bearing Registration No.KL 45 B 5904 near the junction of Kallimandhayam entrance in Dharapuram-Ottanchatram Road. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is innocent and he was falsely implicated in this case and he is no way connected in the above said incident. He has not committed any offence as alleged by the prosecution. Hence, he prays to grant Anticipatory Bail to the petitioner.

4. The learned Additional Public Prosecutor fairly submits that the case was split up against the petitioner and the trial is pending. Due to non-appearance of the petitioner, NBW was issued against him.

5. Heard both sides and perused the materials available on record.

Considering the rival submissions on either side and the fact that already the mother case has been ended in conviction against four accused and as against the petitioner, case was split up, trial is pending, due to non-appearance of the petitioner before the trial Court, NBW was issued against him, it is appropriate to direct the petitioner to appear before the trial Court. Accordingly, the petitioner is directed to appear before the trial Court by filing an appropriate application seeking cancellation of NBW issued against him. On such application is being filed by him, the trial Court is directed to consider the same and pass orders thereon, in accordance with law, on the same day of such application is filed.

7.With the above directions, this Criminal Original Petition is disposed of.
