PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS, directing the 3rd respondent to pass orders on the petitioner's representation dated 27.01.2024 and 25.10.2025, within a time frame as may be fixed by this Court, requesting to conclude the enquiry commenced by them vide proceedings dated 03.08.2022 in O.Mu.A3/4221/2022 and 17.10.2022 in O.Mu.A3/5470/202 and to issue joint patta in the names of the petitioner and the 5th respondent in respect of S.No.44/3A, measuring 46 cents, S.No.79/1, measuring 2 acres 61 cents, and S.No. 79/2, measuring 2 acres 61 cents of Ayyampalayam Village, Musiri Taluk, Trichy District. 1/4

ORDER

The petitioner asserts that the lands in S.No.44/3A(46 cents), 79/1(2 acres 61 cents) and 79/2(2 acres and 61 cents) were assigned by the Government to his paternal grandfather. On the ground that the 5th respondent, who is the petitioner's brother, had wrongly obtained patta exclusively in his name, the petitioner had applied for the cancellation thereof. The petitioner seeks early disposal of such appeal.

2. Learned Additional Government Pleader accepts notice for the respondents 1 to 4. He submits that the 3rd respondent would consider the appeal and pass orders thereon on merits after providing a reasonable opportunity to the petitioner, the pattadhar and the other legal representatives, if any, of late Periyasamy.

3. In view of the above submissions, it is not necessary to issue notice to the 5th respondent in this writ petition. Instead, this writ petition is disposed of by directing the 3rd respondent to consider the petitioner's appeal and pass 2/4

orders thereon on merits within three months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner, the 5th respondent/pattadhar and the other legal heirs of late Periyasamy. A speaking order shall be issued within three months from the date of receipt of a copy of this order. No costs.
