O R D E R
Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for respondents 1 to 3.
2. Issuance of notice to the private respondents is dispensed with.
3. The allegation of the writ petitioner is that the private respondents have unauthorisedly altered the channel route flowing through the petition-mentioned survey numbers. The petitioner is said to be an Ayacutdar. The Government had issued proceedings way back on 26.07.1966 enabling the farmers to alter the route of the channel flowing 2/4
3 W.P.(MD)NO.31698 OF 2025 through their patta lands so as to avoid the parcelling of the lands. Of course, this should be done after getting permission from the jurisdictional Tahsildar. It appears that such action was not taken.
4. We would definitely interfere with if as a result of the deviation committed by the private respondents, free flow of water is affected. The Tahsildar categorically states that there is neither any encroachment nor any obstruction of the water flow. The categorical statement of the Tahsildar is that as a result of the deviation, public have not been affected. Free flow of water into tank has also not been affected. In view of the stand taken by the revenue authority, we decline to issue a writ of mandamus as sought for. This writ petition stands dismissed. No costs.
