Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to transfer the investigation in Crime No.221 of 2022 from the file of the 3rd respondent to the file of the 4th respondent for proceeding further towards filing a final report within the time stipulation as fixed by this Court. ORDER

This Criminal Original Petition is filed to transfer the investigation in Crime No.221 of 2022 from the file of the third respondent to the fourth respondent for proceeding further towards filing a final report within the time stipulation as fixed by this Court.

2. The petitioner seeks transfer of investigation primarily on the ground that the third respondent had not altered the offences in the FIR to Section 307 of IPC inspite of the directions issued by the learned Magistrate. 2/5

3. It is now reported by the learned Additional Public Prosecutor that the offence under Section 307 of IPC has been added and that the final report would be filed in the near future.

4. Since the final report is likely to be filed in the near future and the petitioner's reason for transfer of investigation has also been addressed by the third respondent, this Court finds no reason to transfer the investigation at this stage.
