O R D E R

Heard both sides.

2. The order impugned in the writ petition is appealable. The petitioner has to file an appeal under Section 10 of the Tamil Nadu Land Encroachments Act, 1905. The petitioner undertakes to file such an appeal within a period of three weeks from the date of receipt of a copy of this order. Till the disposal of the appeal, the order impugned in the writ petition will be put on hold and not enforced.

3. We grant such relief because the appeal will become infructuous if the order is enforced in the meanwhile. This benefit will not enure in favour of the writ petitioner, if such an appeal is not filed within the time line as undertaken before us. This writ petition 2/4
