Respondents Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to direct the 4th respondent school to receive the education fee prescribed by the 1st respondent for all the students including the petitioners first son Suresh Babu who is studying SSLC and second son Dhinesh Kumar who is studying 6th Standard at the 4th respondent school and consequently to refund the excess collection of fee to the petitioner and to the other student by considering his representation dated 07.07.2011 within a period stipulated by this Court. For Petitioner : No appearance For Respondents 1-3 : Mr.A.K.Baskarapandian Special Government Pleader.

fourth respondent school.

3.The learned Special Government Pleader appearing for the respondents 1 to 3 submits that since the Department has conducted enquiry and taken steps on the basis of the report submitted by the District Educational Officer, the relief sought for in the present writ petition has become infructuous. Nevertheless, the learned counsel appearing for the fourth respondent states that there is no collection of excess fee, except the fee prescribed under the Rules. 4.The writ petition is closed with the above terms.
