: Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus forbearing the respondents from converting the land situated at T.S No.6087, Ezhil Nagar, Pudukkottai Municipal Corporation, Pudukkottai District, which has been earmarked as Children's Park/Open Space Reservation (OSR) land in the approved Layout Plan (k.g/k(,uh.g[) 54/85 k.g/k(g.g[)1/86) into the Ration Shop, and consequently directing the respondents to preserve, protect, and maintain the said land strictly as Children's Park in accordance with the sanctioned layout and law and pass such other suitable orders.

O R D E R

(Order of this Court was made by P.VELMURUGAN. J.,) The prayer in the writ petition is to forbear the respondents from converting the land situated at T.S No.6087, Ezhil Nagar, Pudukkottai Municipal Corporation, Pudukkottai District, which has been earmarked as Children's Park/Open Space Reservation (OSR) land in the approved Layout Plan (k.g/k(,uh.g[) 54/85 k.g/k(g.g[)1/86) into the Ration Shop, and consequently directing the respondents to preserve, protect, and maintain the said land strictly as Children's Park in accordance with the sanctioned layout and law.

2.The learned counsel appearing for the petitioner represented in the morning that this writ petition may be taken up for hearing today as there is some urgency. So, this Court directed the learned Additional Public Prosecutor to get instructions from the local Inspector of Police, Pudukkottai Town, about the present status. On instructions, the learned Additional Public Prosecutor would submit that though the work has been commenced, after receiving the intimation, they have stopped the work.

3.Mr.S.P.Maharajan, learned Special Government Pleader, who takes notice for the respondents 1 to 3 and 5 would submit that though the 4th respondent initially issued a work order, dated 11/08/2025, subsequently, the same was cancelled, vide order, dated 03/11/2025. 4.Considering the same, the writ petition is disposed of by directing the 4th respondent not to use the land earmarked for children's park for any other purpose other than the land gifted for the purpose of constructing the children's park.
