ORDER : The Court made the following order :- The petitioner / Accused who apprehends arrest in the hands of the respondent police for the offences punishable under Sections 126(2), 296(b), 118(1), 312, 115(2), 351(3) read with 3(5) of BNS 2023, in Crime No.433 of 2025 on the file of the respondent police, seeks anticipatory bail,

2. The case of the prosecution is that the petitioner along with other accused persons had waylaid the defacto complainant and attacked him and snatched the gold chain from the wife of the defacto complainant. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that co-accused had already been granted anticipatory bail by the Principal Sessions Court, Thoothukudi. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.

4. The learned Government Advocate (Criminal Side) submitted that there are 21 previous cases pending against the petitioner and he is the history sheeter in H.S.No.347 of 2022. He further submitted that the petitioner has involved in very serious offence and the investigation is still pending. Hence, he objected to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that the petitioner has involved in very serious offence and the investigation is at initial stage. Further, there are 21 previous cases pending against the petitioner and he is a history sheeter. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 06.11.2025 msrm 3/5
