ORDER
(Order of the Court was made by C.V.Karthikeyan, J.) This Habeas Corpus Petition has been filed complaining that the wife of the petitioner along with his son aged about six years have been missing on and from 10.10.2025. In this connection, FIR had been registered in Crime No.562/2025 under the caption 'woman missing and child missing' by the third respondent police.
2. The matter had come up before us on 10.11.2025, wherein the detenue was produced before us. She was aged about 28 years and she had left the matrimonial home along with minor son aged about 6 years. She informed that she would stay away from the martial home in view of various differences and that she is eking out her livelihood at Kanchepuram. She stated that she would provide education to her son at Kancheepuram and her certificates and the birth certificate of her son to
be handed over back. We had therefore, listed the matter for further hearing today.
3. Today, again the detenu was present along with her son. The petitioner is also present. We had directed handing over the certificates after getting proper acknowledgement. Accordingly, the petitioner had handed over the certificates of the detenu, but there are some other certificates to be returned back and the petitioner had stated that he would hand them over after locating them. Since the detenu is not under illegal confinement and is only eking out her livelihood and had also ensured that she would provide education to her son, no further orders are required.
