ORDER : The Court made the following order :- The petitioner/A6, who was arrested and remanded to judicial custody on 12.08.2025 for the offences punishable under Sections 310(2), 333, 127(7), 311, 351(3), and 332(b) of BNS, 2023 @ Sections 127(7), 310(2), 311, 325, 332(b), 351(3), and 61(2) of BNS, 2023, in Crime No.244 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner and other 5 unknown accused persons were trespassed into the house of the defacto complainant and attacked her husband with wooden log and tied the defacto complainant, her husband and children and sealed their mouth with brown cello tap and threatened them with weapons and robbed 9 1⁄2 sovereigns gold jewels and Rs.1,00,000/- cash and gave them life threat. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offences as alleged by the prosecution, and he has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide 2/4
by any conditions which may be imposed by this Court. Hence, he seeks bail for the petitioner.
4. The learned Additional Public Prosecutor submitted that already this Court has dismissed the bail application of the co-accused. Hence, he opposed for grant of bail to the petitioner.
5. Considering the facts and circumstances of the case and also the fact that already the bail application of the co-accused in this case was dismissed, this Court is not inclined to consider the bail application of the petitioner also.
