ORDER

https://hcservices.ecourts.gov.in/hcservices/ The relief sought for in this writ petition is to call for the

records in relation to the impugned letter issued by the first respondent vide proceedings, dated 19.01.2009. 2.The grievance of the writ petitioner is that the respondents R.C.Schools are to be treated as Corporate and therefore, a transfer from one School to another School is impermissible. However, it is brought to the notice of this Court that it is a Roman Catholic Institution and more specifically run by the minorities. In respect of administering the management, it is the prerogative of the minorities and their rights to administer the institution is constitutionally protected. This being the factum, power of transfer from one School to another school within the same management is certainly permissible and it is the administrative policy of the management running more than one institution. 3.

This apart, the writ petitioner had already joined in the transferred place on 09.01.2015. Thus, the present writ petition also deserves no further consideration. It is made clear that the minority institution has got the power of administration and the same cannot be questioned. Further, it is submitted that the writ petitioner herself was appointed in a transferred vacancy. This being the factum, very ground raised by the writ petitioner is untenable.

4. Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
