ORDER
The petitioner seeks to quash the impugned FIR in Crime No.268 of 2023, on the file of the first respondent police, which was registered for the offences under Sections 143, 290 of IPC. 2.The gist of the allegations is that the petitioner had conducted a protest without prior permission and thus, committed the aforesaid offences.
3.The learned counsel for the petitioner would submit that the petitioner has a right to protest and in any case, the allegations do not constitute the aforesaid offences.
4.The learned Additional Public Prosecutor appearing for the respondent police would fairly submit that the offences in the FIR have 2/4
been altered into Section 290 of IPC, which is punishable with a fine of Rs.200/-.
5.Though the impugned FIR was filed on 12.05.2023, the respondent police have not filed the final report so far. The final report would be barred by limitation, even if they are now allowed to file the final report, as the offence against the petitioner is only under Section 290 of the IPC, which is punishable with a fine of Rs.200/-. Hence, this Court is inclined to quash the impugned final report, as no useful purpose would be served in keeping the matter pending and allowing the respondent police to file final report.
6.Accordingly, this Criminal Original Petition is allowed and the impugned FIR in Crime No.268 of 2023, on the file of the first respondent police is quashed. Consequently, connected miscellaneous petition is closed.
