ORDER : The Court made the following order :- The petitioners/A1 to A3 & A5, who were arrested and remanded to judicial custody from 02.02.2025 for the offences punishable under Section 103(1) of BNS, 2023 @ Sections 103(1), 191(2), 191(3), 238 and 61(2) of BNS, 2023, in Crime No.2 of 2025 on the file of the respondent police, seek bail.

2. The case of the prosecution is that the due to money dispute between the son of the deceased and A1, the petitioners and other accused persons murdered the deceased. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and have not committed any offences as alleged by the prosecution, and they have been falsely implicated in this case. He further submitted that the petitioners are ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks bail for the petitioners.

4. The learned Additional Public Prosecutor submitted that due to money dispute between the son of the deceased and the accused persons, the accused called the deceased for compromise talk and murdered him. Further all the petitioners have previous cases ie., A1 is having 12 previous cases, A2 is having 9 previous cases, A3 is having 9 previous cases and A5 is having 6 previous cases. Hence, he opposed for grant of bail to the petitioners.

Considering the facts and circumstances of the case and also the fact that the petitioners have murdered the defacto complainant's husband and all the accused have previous cases viz., 12, 9, 9 & 6 respectively, this Court is not inclined to consider the bail application.
