ORDER

The petitioner seeks to quash the impugned proceedings in Cr.M.P.No.8390 of 2024 pending on the file of the learned Judicial Magistrate Court No.II, Ramanathapuram.

2.It is the grievance of the petitioner that though the alleged occurrence is said to have been taken place on 13.06.2017, the impugned final report was filed belatedly on 18.10.2024 and that since the case is pending for a long time, the right of the petitioner to a speedy trial has been violated.

3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the respondent police had filed the final report on 18.10.2024 along with the petition in Crl.M.P.No.8390 of 2024, seeking condonation of the delay under Section 473 Cr.P.C and the same is is pending enquiry and notice has been issued to the petitioner. 4.Admittedly, the respondent police have filed the final report belatedly and the petition seeking condonation of delay is still pending . 2/4

Therefore, the petitioner shall file his objections to the petition filed by the respondent police and the learned Judicial Magistrate Court No.II, Ramanathapuram, is directed to consider the same and pass appropriate orders in accordance with law.

5.With the above direction, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petitions are closed.
