By alleging that the second and third respondents have relied on two invalid settlement deeds to claim a larger extent of 13 cents in survey No.447/11 C, the petitioner has filed this Writ Petition to restrain grant of patta to the private respondents for the said extent of 13 cents.

2. Learned counsel for the petitioner submits that an erroneous survey was carried out and that an appeal has been lodged before the Deputy Director of Survey, Trichy, in respect thereof. He also submits that the settlement deeds are not valid and that the private respondents are endeavouring to obtain a patta on such basis.

3. Learned Special Government Pleader accepts notice for the first respondent and Mr.V.G.Vallarasu Chezhiyan, learned counsel, accepts notice for the respondents 2 and 3. Learned Special Government Pleader points out that the petitioner should approach the jurisdictional civil court if he intends to challenge settlement deeds dated 26.09.2025. Therefore, he submits that the present petition is misconceived. 2/4

From the averments in the affidavit and the representation, it appears that the grievances of the petitioner relate to the survey, which has already been challenged before the Deputy Director of Survey and settlement deeds dated 26.09.2025. As regards the latter as submitted by learned Special Government Pleader, the remedy lies elsewhere. Consequently, this Writ Petition is dismissed without any order as to costs by leaving it open to the petitioner to assail the settlement deeds before the jurisdictional civil court and to prosecute the pending appeal before the Deputy Director of Survey.
